Non-EU Student in Germany Forex trading Legality

Hi Traders,

I need clarification on few things regarding the regulations in Germany for Non-European student who wants to trade in Forex Market.

1) Whether Non-EU student(doing PG) in Germany can trade in Forex/ Binary options ?

2) If its Legal for Non-EU student in Germany to trade in forex, does trading activity gets counted under part-time work hours ?

3) Does trading is considered as self-employment in Germany ?

I want to trade within the limits of legality. Don't want to take any risk.

Can someone who knows about trading regulations in Germany / EU nations Please clarify...

Disclaimer: I am not an expert, and the answers below may be false.

(1) I do not see any reason not to trade FOREX or binary options. Of course you need to find a broker willing to open an account for you.

(2) Trading is not considered as an industry. Your trading profits or losses are subject to capital gains tax. Capital gains are taxed at 26.4 %.

(3) If you trade your own account this is not being considered as self-employment.

Please check this with a tax lawyer.

Legit and officially regulated forex brokers demand you trade with a broker that services your LEGAL and permanent residence.

That said, there's a lot of off-shore brokers that you will need to fund with BTC that can take you. However you will be trading spot price and not futures. They are not regulated so you may experience shady practices if you choose the off-shore route.

I have no doubt in my mind that you are going to lose your money to be honest. It's very sobering, but you need to ready yourself.

Commodities and currencies are not stocks.
